These Terms of Service govern your access to and use of AutoPartsStop and your purchase of products from us. Please read them carefully.
1. Acceptance of these terms
AutoPartsStop (the “Site”) is operated by APS Global LLC (“we,” “us,” or “our”). By accessing or using the Site, or by placing an order, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to purchase from the Site. By ordering, you represent that the information you provide is accurate and that you are authorized to use the payment method presented.
3. Products, pricing and availability
We work to describe and price products accurately, but we do not warrant that product descriptions, pricing, fitment data or other content are complete or error-free. Prices and availability are subject to change without notice.
If a product is listed at an incorrect price or with incorrect information due to an error, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed, and to correct the error. We also reserve the right to limit order quantities.
4. Fitment and compatibility
We provide vehicle fitment data to help you select the correct part. You are responsible for confirming that a part is correct for your vehicle before installation. If our fitment data indicates a part fits your year, make and model and it does not, that is our error and is covered by our Return Policy. Parts installed despite a known or visible mismatch are not eligible for return.
5. Orders and payment
Your order is an offer to buy. We may accept or decline it, and no contract exists until we confirm the order. Payments are processed securely by our third-party payment processor (Stripe); we do not store full payment card numbers on our systems. You authorize us and our processor to charge your selected payment method for the total shown at checkout, including applicable taxes and any shipping fees.
Sales tax is applied based on the shipping destination where we have a tax obligation.
6. Shipping and delivery
Delivery dates and shipping estimates are estimates only. Title and risk of loss pass to you upon our delivery of the goods to the carrier. We are not liable for delays caused by carriers or events beyond our reasonable control.
7. Returns and refunds
Returns are governed by our Return Policy, which is incorporated into these Terms by reference.
8. Warranties and disclaimer
Parts may carry a manufacturer warranty, the terms of which are set by the manufacturer. Except for any applicable manufacturer warranty and your rights under applicable law, the Site and all products are provided “as is” and “as available,” and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, APS Global LLC and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or any product. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless APS Global LLC from any claims, damages or expenses arising out of your misuse of the Site, your violation of these Terms, or your installation or use of any product in a manner inconsistent with its instructions and intended application.
11. Intellectual property
The Site and its content — including text, graphics, logos and software — are owned by or licensed to APS Global LLC and are protected by intellectual-property laws. You may not copy, reproduce or create derivative works from the Site without our written permission. Brand names and trademarks are the property of their respective owners.
12. Acceptable use
You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to scrape or harvest data without permission, or to submit false or fraudulent orders.
13. Third-party links
The Site may link to third-party websites or services that we do not control. We are not responsible for their content, policies or practices.
14. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Georgia have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.
15. Changes to these terms
We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above reflects the latest revision. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
